ROMIĆ: DECISIONS MADE BY INCOMPLETE CONSTITUTIONAL COURT OF BiH CANNOT BE APPLIED IN SRPSKA
BANJA LUKA, NOVEMBER 14 /SRNA/ - Advisor to Republika Srpska President, Marko Romić, tells SRNA that the BiH Supreme Constitutional Court’s decision declaring unconstitutional certain provisions of the Law on Srpska’s Immunity is a continuation of the terror this Court is trying to implement not only on Srpska, but on the entire Dayton structure of BiH.
Romić emphasized that with this and similar decisions, an attempt is being made to completely delegitimize one entity, i.e. Republika Srpska and two constituent peoples, namely the Serbs and the Croats. He stated that the truncated Constitutional Court of BiH confirmed a serious anomaly in its work at today's session. "First of all, we are talking about the unconstitutional composition of this morning's session. Namely, a few days ago, when she turned 70, Judge Seada Palavrić ceased to be a judge of the Constitutional Court of BiH, because according to the explicit norm of the Constitution of BiH, a judge who has turned 70 cannot perform that duty," explained Romić. Therefore, Romić emphasized, on the one hand we have an unconstitutional composition of the Constitutional Court of BiH, on the other hand, all decisions made by a truncated composition of the Constitutional Court of BiH cannot be applied in Republika Srpska and will not be published in accordance with the law passed by the Srpska National Assembly. The incomplete Constitutional Court of BiH made a decision today claiming the articles of the Law on Republika Srpska Immunity, which prescribe immunity from criminal responsibility for the holders of executive power, are not in accordance with the Constitution of BiH. The decision reads the BiH Immunity Law does not prescribe immunity from criminal liability for the holders of executive power, but only immunity from civil liability for what they do while performing their duties.
