ANOTHER ATTEMPT TO INFLUENCE CONSTITUTIONAL ORDER OF SRPSKA THROUGH POLITICAL, NOT CONSTITUTIONAL-LEGAL ARGUMENTS
BANJA LUKA, JANUARY 23 /SRNA/ – Minister of Justice Goran Selak told SRNA that the latest decision of the incomplete Constitutional Court of BiH is one in a series of attempts to influence the constitutional order of Republika Srpska through political rather than constitutional and legal arguments.
Following the decision of the incomplete Constitutional Court of BiH, which questioned the constitutionality of the procedure for granting the mandate and electing the Government of Republika Srpska on September 2, Selak stressed that Republika Srpska acted responsibly and in accordance with its constitutional competencies. For this very reason, he added, taking into account institutional stability and legal certainty, all necessary steps were taken in a timely manner to ensure the uninterrupted functioning of government. “Today I clearly state: Republika Srpska has a Government that was legally elected, legitimate, and confirmed by the competent legislative bodies of Republika Srpska. All attempts to create an institutional crisis through political pressure have failed,” Selak emphasized. According to him, the Government of Republika Srpska and all ministries continue to operate at full capacity, with full legitimacy, in the interest of citizens and in accordance with the Constitution and laws of Republika Srpska. The incomplete Constitutional Court of BiH, operating without Serb judges, considers the previous term of the Government of Republika Srpska to be “unconstitutional.” At a two-day session, the incomplete Constitutional Court of BiH assessed that the decisions adopted by the previous Government of Republika Srpska from September 2 last year until January 18 this year “were contrary to the provisions of the Constitution of BiH.”
