DECISIONS OF INCOMPLETE CONSTITUTIONAL COURT CANNOT BE CONSTITUTIONAL, COURT PRESIDENT’S MANDATE EXPIRED

BANJA LUKA, JANUARY 23 /SRNA/ – Decisions of the Constitutional Court of BiH cannot, under any circumstances, be constitutional, as the court is presided over by Mirsad Ćeman, whose mandate expired upon reaching the age of 70, Professor of Legal Sciences Ljubinko Mitrović told SRNA.

BANJA LUKA, JANUARY 23 /SRNA/ – Decisions of the Constitutional Court of BiH cannot, under any circumstances, be constitutional, as the court is presided over by Mirsad Ćeman, whose mandate expired upon reaching the age of 70, Professor of Legal Sciences Ljubinko Mitrović told SRNA.



“Decisions of an unconstitutional Constitutional Court of BiH cannot, in any case, be constitutional or based on the Constitution of BiH,” Mitrović emphasized. Explaining why the Constitutional Court of BiH is unconstitutional, Mitrović said that for months the court has been chaired and adjudicated by Judge, and even President of the Court Mirsad Ćeman, who was born on December 1, 1955, and who, upon reaching the age of 70, should have been retired. He explained that this is in accordance with the provision of Article VI/1, item “C”, which states that “judges appointed after the first composition shall serve until reaching the age of 70.” “In any case, upon reaching the age of 70, his mandate expired. This happened to all judges before him, with the exception of Suada Palavrić,” Mitrović noted. Earlier today, the incomplete Constitutional Court of BiH adopted a decision deeming the previous composition of the Government of Republika Srpska to be “unconstitutional.”
