PETKOVIĆ: I HOPE THE CONSTITUTIONAL COURT WILL RECOGNISE THAT NO ONE CAN PASS LAWS EXCEPT THE PARLIAMENTARY ASSEMBLY
SARAJEVO, FEBRUARY 13 /SRNA/ – Deputy Chair of the Constitutional-Legal Committee of the House of Representatives of the BiH Parliamentary Assembly Milan Petković says he hopes that the Constitutional Court of BiH will acknowledge that the highest legislative body in BiH has taken an official position that no one else, regardless of their office, can pass laws except the Parliamentary Assembly of BiH.
Petković has reminded that the Committee first took a position that the High Representative does not have the right to pass or impose laws, and that it officially informed the Constitutional Court of BiH about this. He has stated that today, the Constitutional Court's request for the Committee to express its opinion on the constitutionality of the BiH Criminal Code, specifically the appeal filed by SNSD deputies in the Republika Srpska National Assembly, was discussed. "The appeal requests that the Constitutional Court of BiH declare unconstitutional the imposed amendments to the BiH Criminal Code, specifically Article 203a, which were imposed by Schmidt and became part of BiH legislation. The Constitutional-Legal Committee adopted the conclusion I proposed as its member," Petković told the press. He explained that with this conclusion, the Constitutional Court of BiH was informed that the High Representative in BiH does not have the right to pass or impose laws because it is not in accordance with the BiH Constitution. "The conclusion was adopted with four votes in favour and three against," Petković added.
