TWO COMMISSION MEMBERS’ DECISION - ATTACK ON THE BIH CONSTITUTION, CRIMINAL COMPLAINTS TO FOLLOW

SARAJEVO, AUGUST 1 /SRNA/ – Anđelina Ošap-Gaćanović, a member of the Commission preserving National Monuments of BiH, told SRNA that she had been informed by email that an order had been issued to retroactively deregister her from the institution, although there were no legal grounds for it, announcing filing complaints with all competent institutions, as such action constitutes an attack on the BiH Constitution.

SARAJEVO, AUGUST 1 /SRNA/ – Anđelina Ošap-Gaćanović, a member of the Commission preserving National Monuments of BiH, told SRNA that she had been informed by email that an order had been issued to retroactively deregister her from the institution, although there were no legal grounds for it, announcing filing complaints with all competent institutions, as such action constitutes an attack on the BiH Constitution.



Ošap-Gaćanović said that Mirzah Fočo, the Commission's executive official, had ordered that she and fellow Commission member Faruk Kapidžić from the FBiH be deregistered as employees of the Commission, although there were no legal grounds for it. She stresses she believes the order originated from the Office of the Bosniak member of the BiH Presidency, Denis Bećirović, which is why she would file criminal complaints. "Yesterday I received an email informing me that Fočo had ordered that Kapidžić and I be deregistered as employees of the Commission, based on the Presidency's decision of June 29 appointing the international members and the members from the FBiH as the new composition of the Commission," Ošap-Gaćanović said and recalled that the decision never entered into force because the National Assembly upheld the veto of the Serb Presidency member, Željka Cvijanović. Gaćanović believes Fočo most likely made the decision to deregister her and Kapidžić retroactively, effective July 8, in coordination with the Office of the Bosniak Presidency member. "What is particularly concerning is the violation of labour rights through retroactive deregistration, which in itself indicates that this was a deliberate attempt by those who issued the order, namely Bećirović's Office, to implement the decision, which in a view, points to the criminal offence of abuse of office," Gaćanović stressed. According to her, by issuing such an order, Fočo is accepting responsibility for paying the legally prescribed fine of between BAM 3,000 and BAM 20,000 for the retroactive deregistration of her and Kapidžić solely to enforce a decision that is legally invalid. She further alleged that a civil servant removed both her and Kapidžić from the ISFU system of the Ministry of Finance and Treasury within the Council of Ministers, which amounted to an abuse of office aimed at implementing an invalid legal decision that confirmed that the action had been taken on instructions from Bećirović's Office. Gaćanović emphasizes that such actions also constitute a direct attack on the Constitution and unconstitutional conduct by Bećirović's Office. "What is particularly worrying is the involvement of UNESCO experts in this session, in these anti-Dayton moves and in undermining the Constitution," Gaćanović stresses.
