TADIĆ: HIGH REPRESENTATIVES CANNOT ENACT LAWS, ESPECIALLY NOT SCHMIDT
ISTOČNO SARAJEVO, FEBRUARY 13 /SRNA/ – High Representatives cannot enact laws in BiH, and in the case of Christian Schmidt this is even clearer, because he is not a High Representative at all, lawyer Ognjen Tadić told SRNA.
"That has long been clear to everyone, even to those who publicly claim otherwise," Tadić said. Accordingly, he stressed, the position of the Constitutional-Legal Commission of the House of Representatives of the Parliamentary Assembly of BiH is fully grounded in the Constitution of BiH and the Dayton Peace Agreement. In any state governed by the rule of law, Tadić noted, this would mean that a decision challenging Christian Schmidt's interventions in the Criminal Code of BiH could be expected from the Constitutional Court of BiH. However, due to his responsibility, the responsibility of official Sarajevo, and numerous foreign politicians, BiH has never become a state governed by the rule of law, so it is completely uncertain how the incomplete Constitutional Court of BiH will treat such a clear and correct position of the competent parliamentary commission. At today's session, the Constitutional-Legal Commission of the House of Representatives of the Parliamentary Assembly of BiH adopted a conclusion stating that the high representative does not have the constitutional authority to enact laws, and that therefore the provisions of the Law on Amendments to the Criminal Code of BiH are unconstitutional. The conclusion was adopted in response to a request from the Constitutional Court of BiH for a review of the constitutionality of Article 203a of the Criminal Code of BiH, as well as Article 4 of the Law on Amendments to the Criminal Code of BiH, the Parliamentary Assembly of BiH announced.
