KARAN: CONSTITUTIONAL COURT OF BiH SHOULD RETURN TO RESPECTING DEMOCRATIC PRINCIPLES
BANJALUKA, JUNE 24 /SRNA/ - The President of Republika Srpska Siniša Karan said that he expects the truncated Constitutional Court of BiH to return, through its future decisions, to the principles of respecting the electoral will of citizens, which is the foundation of every democratic society, as well as constitutionality, legality, the rule of law, and a legal state.
Karan told reporters in Banja Luka that the Constitutional Court of BiH, although a Dayton category, unfortunately, does not protect the constitutional order at all. "All constitutional courts in the world protect the constitutional order, and that should be their only jurisdiction. However, the Constitutional Court of BiH has, for more than 30 years, undermined the constitutional order of Republika Srpska, and thereby that of BiH as well. It has undermined the basic principles of every democratic society, whose foundations are free and direct elections, constitutionality, legality, the rule of law, and a legal state," Karan stressed. He assessed that the people in the Constitutional Court of BiH are not defenders of the constitution, but rather its destroyers. "I don't expect anything from them because they had many opportunities to turn the unfortunate BiH into a state based on democratic principles, which was not respected," Karan said, referring to the fact that the truncated Constitutional Court of BiH, after more than half a year, placed on the agenda of its session the review of the constitutionality of interventions by Christian Schmidt in the Criminal Code of BiH. The appeal filed by the SNSD Caucus in the National Assembly of Republika Srpska requesting a constitutional review of certain provisions of the Criminal Code of BiH imposed by Schmidt is on the agenda of the truncated Constitutional Court session scheduled for July 2 and 3.
