ILIĆ: STRASBOURG COURT TO OVERTURN BiH JUDICIARY ERRORS

BANJA LUKA, NOVEMBER 5 /SRNA/ – Legal expert Mladen Ilić stated that the decision of the incomplete Constitutional Court to reject the appeal of President Milorad Dodik’s defense represents a collapse of the rule of law in BiH. He emphasized that the European Court of Human Rights in Strasbourg can be expected to overturn all errors of the BiH judiciary.

BANJA LUKA, NOVEMBER 5 /SRNA/ – Legal expert Mladen Ilić stated that the decision of the incomplete Constitutional Court to reject the appeal of President Milorad Dodik’s defense represents a collapse of the rule of law in BiH. He emphasized that the European Court of Human Rights in Strasbourg can be expected to overturn all errors of the BiH judiciary.



He noted that the Constitutional Court of BiH does not even have all the judges who should sit in the institution. "We have been aware from the beginning that this is a politically staged process, with no connection to law, but solely to politics," Ilić told SRNA, calling the entire process a farce of the BiH judiciary. He pointed out that it was important for President Milorad Dodik’s defense to file an appeal with the Constitutional Court so that justice could later be sought at the European Court of Human Rights. According to him, it can be expected that the Strasbourg Court will annul such a process. "From that perspective, it was necessary to enter this appeal procedure in order to later create the possibility of going to European courts," said Ilić, who is a member of the National Assembly of Republika Srpska. The incomplete Constitutional Court of BiH yesterday rejected the appeal of President Milorad Dodik's defense against the ruling of the BiH Court, which sentenced him to one year in prison and a six-year ban on political activity for "non-compliance with the decisions of Christian Schmidt".
